State Council's Opinions on Strengthening Key Environmental Protection Work

The People's Government of the People's Republic of China [2011] No. 35 provinces, autonomous regions, and municipalities directly under the Central Government, the ministries and commissions of the State Council, and the agencies directly under the State Council:

Over the years, China has actively implemented the strategy of sustainable development, placed environmental protection on an important strategic position, and continuously increased its efforts to solve environmental problems, achieving remarkable results. However, due to the fact that the industrial structure and layout are still not reasonable, the level of pollution prevention and control is still low, and the environmental supervision system is not yet perfect. The environmental protection situation is still very serious. In order to deeply implement the scientific concept of development, accelerate the transformation of economic development methods, and improve the level of ecological civilization construction, we now put forward the following opinions on strengthening the key tasks of environmental protection:

First, comprehensively improve the level of environmental protection supervision and management (a) strictly enforce the environmental impact assessment system. All major watersheds, regional development and industry development plans and construction projects that should be subject to environmental impact assessment according to law must strictly implement the environmental impact assessment procedures and take the total pollutant discharge control index as a pre-approval for the environmental impact assessment of new renovation and expansion projects. Set the conditions. The environmental impact assessment process must be open and transparent and fully solicit public opinions. Establish a sound linkage mechanism for planning environmental impact assessment and construction project environmental impact assessment. Unauthorized environmental impact assessment documents without approval, such as unauthorized start of construction, during the construction process without making any major changes, without unauthorized acceptance of the operating acceptance of environmental protection and other illegal activities, shall be investigated according to law, management departments, related companies and personnel responsibilities.

(B) continue to strengthen the total emission reduction of major pollutants. Improve the statistics, monitoring, and assessment system for emission reduction, and encourage the implementation of total pollutant emission control in all regions. The total discharge of chemical oxygen demand and ammonia nitrogen shall be controlled in the papermaking, printing, dyeing, and chemical industries. Strengthen the construction of sewage treatment facilities, sludge treatment and disposal facilities, sewage recycling facilities and landfill leachate treatment facilities. Upgrading existing wastewater treatment plants. Improve the urban sewage collection pipe network and promote the transformation of rain and sewage diversion. Strengthen the operation and supervision of urban sewage and garbage treatment facilities. To control the total amount of CO2* and NO x emissions in the power industry, continue to strengthen the removal of coal-fired power plants, fully implement denitrification in coal-fired power plants, and establish de-NOx facilities in new coal-fired units. To control the total amount of CO2 emissions in the steel industry, and to strengthen the treatment of CO2 and NOx in cement, petrochemical and coal chemical industries. In the key areas of joint prevention and control of air pollution prevention and control, trials of total coal consumption control will be carried out. Promote the reduction of pollution in agriculture and rural areas, and focus on prevention and control of pollution in livestock and poultry farming.

(3) Strengthen supervision of environmental law enforcement. We will promptly promote the formulation and revision of relevant laws and regulations to provide a more complete and effective legal protection for environmental protection. We will improve law enforcement procedures, regulate law enforcement, and establish a law enforcement responsibility system. Strengthen daily supervision of environmental protection and law enforcement inspections. We will continue to carry out special environmental protection campaigns for rectifying illegal polluting enterprises to protect people's health, and conduct post-inspection on the implementation of environmental laws and regulations and the rectification of environmental issues. Establish the environmental supervision system for the whole process of construction projects and the rural and ecological environment monitoring system. Improve cross-administrative regional environmental law enforcement cooperation mechanisms and departmental joint enforcement mechanisms. Dispose of environmental pollution and ecological damage in accordance with the law. Implementation of the supervision system for watersheds, regions, industries, and batch inspections. The local government leaders responsible for failing to complete the environmental protection goals and tasks or the occurrence of major environmental emergencies were interviewed to implement the corrective measures. Promote the extension of producer responsibility system. Deepen the enterprise environmental supervisor system and implement qualified management. (D) Effectively prevent environmental risks and properly handle emergencies. We will improve the environmental risk management system that focuses on prevention, implement environmental emergency classification, dynamics, and overall process management, and scientifically and properly dispose of environmental emergencies in accordance with law. Build more efficient environmental risk management and emergency rescue systems to improve environmental emergency monitoring and disposal capabilities. Formulate practical and feasible environmental emergency plans, allocate necessary emergency relief supplies and equipment, strengthen environmental emergency management, technical support and the construction of rescue teams, and regularly organize training and drills. Conduct key river basin and regional environmental and health surveys. Efforts should be made to do a good job in the emergency handling of pollution incidents, timely and accurate release of information, to reduce the loss of people's lives and property, and damage to the ecological environment. We will improve the accountability system, strictly implement the corporate environmental security main responsibility, and strengthen the local government's responsibility for environmental safety supervision.

Second, efforts should be made to address outstanding environmental issues that affect scientific development and damage to people's health. (5) Effectively strengthen the prevention and control of heavy metal pollution. Focus on prevention and control of heavy metal pollution areas, industries and enterprises to conduct centralized management. Reasonably adjust the layout of enterprises involved in heavy metals, strictly implement the health protection distance, and resolutely prohibit the newly renovated and expanded projects that increase the total amount of heavy metal pollutants in key prevention and control regions. Strengthen the environmental supervision of heavy metal related companies to ensure compliance with standards. For heavy metal polluting enterprises that have caused pollution, they must increase penalties and take limited-term remediation measures. If they fail to meet the requirements, they shall be shut down according to law. Standardize the recycling and disposal of waste electrical and electronic products, build a recycling system for waste products, and centralize processing and processing zones. Actively and properly handle the issues left over by history of heavy metal pollution.

(6) Strict chemical environmental management. We will carry out a review and assessment of the layout of chemical projects and promote the scientific planning and rational distribution of petroleum and chemical projects. We will conduct environmental inspections of chemical production and operation enterprises, carry out comprehensive remediation of chemical companies in the ocean, rivers and lakes, and strengthen safety and security measures. Take environmental risk assessment as an important part of the evaluation of hazardous chemical projects, improve environmental access conditions and construction standards for chemical production, and scientifically determine and implement environmental protection distances for chemical construction projects. Eradicate the use of chemicals that are highly toxic, difficult to degrade, and highly hazardous to the environment, and restrict the production and use of high-risk chemicals. Promote the ecological design of industrial products. We will improve the entire process environmental management system for chemicals. Strengthen supervision and management of key industries for persistent organic pollutant discharge. Establish a lifelong accountability system for chemical environmental pollution liability and the entire process of administrative accountability.

(7) Ensure nuclear and radiation safety. Taking nuclear facilities as the focus of supervision, it will strengthen the safety review and assessment of new and expanded nuclear facilities, and promote the decommissioning of old nuclear facilities and the treatment of radioactive waste. Strengthen the safety management and radiation protection for the production, transportation and storage of nuclear materials and radioactive materials, and promote the environmental protection of mines and associated radioactive mines. Strengthen radiation environment management such as radiation sources, radiation devices, high-voltage transmission and transformation, and mobile communication engineering. We will improve nuclear and radiation safety review methods, improve the radiation environment monitoring and supervision system, promote the construction of national nuclear and radiation safety supervision and technology research and development bases, and build supervision and technical support platforms.

(8) To deepen the comprehensive prevention and control of pollution in key areas. Strictly divide and manage drinking water source protection areas, conduct regular water quality analysis, implement water source environmental remediation, restoration and construction projects, and improve water quality standards. Conduct groundwater pollution investigations, risk assessments, and repair demonstrations. We will continue to promote the prevention and control of water pollution in key river basins and improve the assessment mechanism. Strengthen pollution control of Poyang Lake, Dongting Lake, Hongze Lake and other lakes. Increase protection for water quality or ecologically fragile lakes. It is forbidden to carry out reclamation activities in places that may cause serious ecological imbalances, strengthen the pollution control of rivers entering the sea and supervision and management of sea outlets, and improve the environmental quality of the Bohai Sea and the estuaries of the Yangtze River, the Yellow River, and the Pearl River. Revise the ambient air quality standard, increase the monitoring index of atmospheric pollutants, and improve the method of environmental quality assessment. We will improve the joint prevention and control mechanism for air pollution in key regions, implement coordinated control of various pollutants, and strictly control the emission of volatile organic pollutants. Strengthen odor, noise and control of restaurant fume pollution. Increase the harmless treatment of urban living garbage. Strengthen the prevention of industrial solid waste pollution and strengthen the management of hazardous waste and medical waste. If the contaminated site is used again for development and utilization, it shall be subject to environmental assessment and harmless treatment. Implement mandatory cleaner production audits for key companies. Promote the environmental performance assessment of polluting companies and strictly verify the environmental protection of listed companies. We will carry out in-depth development of urban environment comprehensive renovation and environmental protection model cities.

(9) To vigorously develop the environmental protection industry. Increase policy support and expand the market demand for environmental protection industry. Encourage multi-channels to establish environmental protection industry development, and broaden the development of environmental protection industry. The implementation of advanced environmental protection and applicable technology research and development applications, major environmental protection technology and equipment and product industrialization demonstration projects. It focuses on the development of environmental service industries such as socialized operation of environmental protection facilities, environmental consulting, environmental supervision, engineering technology design, and certification assessment. Encourage the use of environmental labels, environmental certifications and green printing products. To carry out pollution reduction technology research, implementation of water pollution control and governance and other major science and technology projects. Develop environmental industry statistics standards. Strengthen the study of environmental benchmarks and promote the construction of key national environmental protection laboratories and engineering technology centers. Strengthen the environmental disciplines and majors in colleges and universities.

(10) Accelerate the promotion of rural environmental protection. We will implement a target responsibility system for comprehensive improvement of the rural environment. We will deepen the policy of “inviting governance through rewards” and “replacing subsidies with awards” to expand the scope of contiguous remediation, focus on rectifying villages and market towns with outstanding environmental problems, and focus on the control of pollution of rural soil and drinking water sources. Continue to carry out soil environmental surveys and conduct pilot demonstrations of soil pollution control and rehabilitation. Promote environmental protection infrastructure and services to extend to rural areas and strengthen the construction of rural domestic garbage and sewage treatment facilities. The development of ecological agriculture and organic agriculture, the scientific use of chemical fertilizers, pesticides and agricultural film, to effectively reduce non-point source pollution. Strictly control the burning of crop straws and promote the utilization of agricultural production wastes. Strengthen the treatment of human and animal manure and harmless packaging of pesticides in rural areas. Increase the prevention and control of pollution in industrial and mining enterprises in rural areas to prevent the transfer of pollution to rural areas. Develop agricultural and rural environmental statistics.

(11) Strengthen ecological protection. The state compiles environmental function zoning, and delimits ecological red lines in important ecological function areas, land and marine ecologically sensitive areas, and vulnerable areas, and formulates corresponding environmental standards and environmental policies for various major functional areas. Strengthen the ecological protection of the Qinghai-Tibet Plateau ecological barrier, the Loess Plateau-Chuanxi ecological barrier, the northeastern forest zone, the northern desertification zone, the southern hilly terrain, and the important river systems of the big rivers and rivers. Promote ecological restoration and allow important ecosystems such as rivers and lakes to recuperate. Strengthen the protection of biodiversity, establish biodiversity monitoring, assessment and early warning systems, and access and benefit sharing systems for biological genetic resources to effectively prevent loss and loss of species resources. Strengthen the comprehensive management of nature reserves. Conduct ecosystem condition assessments. Strengthen the ecological protection of minerals, hydropower, tourism resources development and transportation infrastructure construction. We will promote the pilot project of ecological civilization construction and further develop ecological demonstration activities.

Third, the reform and innovation of the environmental protection system and mechanism (12) continue to promote the historic transformation of environmental protection. (13) Implementing economic policies that are conducive to environmental protection. We will include environmental protection in budgets for fiscal years at all levels and gradually increase input. Increase the funding arrangements for capacity building at the same level in a timely manner. We will increase investment in prevention and control of water pollution in key river basins and improve the management of special funds for water pollution control in key river basins. We will improve the central government's transfer payment system and increase the transfer payment for environmental protection in the central and western regions, ethnic autonomous areas, and key ecological function areas. Accelerate the establishment of ecological compensation mechanisms and special national ecological compensation funds to expand the scope of ecological compensation. Actively promote environmental tax reform and study the introduction of environmental protection taxes. For enterprises that meet the standards for the next phase of vehicle fuel, they will be given preferential treatment on consumption tax policies. Formulate and improve a comprehensive directory of environmental protection. We will study and adjust import and export tariff policies for products that are "highly polluting and have high environmental risks." Support eligible companies to issue bonds for environmental protection projects. Increase credit support for companies and projects that meet environmental protection requirements and credit principles. Establish corporate environmental behavior credit evaluation system. We will improve the system of liability insurance for environmental pollution and launch trials for compulsory liability insurance for environmental pollution. Strict implementation of coal-fired power plant flue gas off the price policy, the establishment of denitrification price policy. Priority will be given to the implementation of policy support for renewable energy generation, waste heat power generation, and waste incineration power generation. For the high energy-consuming and high-polluting industries, differentiated electricity prices will be implemented, and preferential policies will be implemented for encouraged enterprises such as sewage treatment, sludge harmless treatment facilities, non-power industry de-nitrification, and waste treatment facilities. In accordance with the requirements for the sound disposal of sludge, garbage, and medical waste, we will improve the charging standards and promote the reform of collection methods. The implementation of the permit system for discharge of pollutants, the launching of trials for paid use of emission rights and trading, the establishment of a national emission trading center, and the development of emission trading market.

(14) Continuously enhance environmental protection capabilities. We will comprehensively promote the standardization of environmental protection capabilities such as monitoring, monitoring, education, and information. We will improve urban air quality, key watersheds, groundwater, national key monitoring sites for agricultural products and auto-monitoring networks at or above the prefecture level, expand the scope of monitoring, and build a national environmental monitoring network. Promote the construction of special satellites for the environment and their applications, and improve remote sensing capabilities. Strengthen the construction of pollution source automatic monitoring system, supervision and management, operation and maintenance. We will launch a national environmental education and education action plan, nurture and strengthen the environmental protection volunteer team, and guide and support the public and social organizations to carry out environmental protection activities. Enhance environmental information basic capabilities, statistical capabilities, and business application capabilities. Build an environmental information resource center to strengthen the R&D and application of the Internet of Things in areas such as automatic monitoring of pollution sources, real-time monitoring of environmental quality, and transportation of dangerous chemicals, and promote the sharing of information resources.

(15) Improve the environmental management system and working mechanism. Establish a comprehensive decision-making mechanism for environmental protection. Improve the environmental monitoring and supervision system and strengthen the national environmental monitoring function. Continue to implement the dual management system of leading cadres of the environmental protection department. Encourage qualified areas to carry out pilot projects for the comprehensive reform of the environmental protection system. In conjunction with the reform of local people's government agencies and the reform of township and township organizations, the supervision and administration model for the establishment of environmental protection agencies in the cities under the districts should be explored, and the grassroots environmental management system should be perfected. Strengthen nuclear and radiation safety supervision functions and team building. Implement the medium and long-term plans for the development of ecological environmental protection personnel.

(16) Strengthen the leadership and assessment of environmental protection work. Local people's governments at all levels must effectively put environmental protection in the overall position of prominent work, include them on the agenda, clearly define the objectives and tasks, improve policies and measures, and organize and implement national key environmental protection projects. The formulation of the target indicator system for the construction of ecological civilization was included in the performance appraisal of local people's governments at all levels, and the assessment results were taken as an important part of the comprehensive assessment of leading groups and leading cadres, and were used as an important basis for the selection, appointment, management and supervision of cadres, and one vote for environmental protection was rejected. system. Regional approvals will be imposed on those places that have not completed the assessment of the target mission, and the approval of projects related to the people’s livelihood projects, energy conservation and emission reduction, ecological and environmental protection, and infrastructure construction will be suspended, and relevant leadership responsibilities will be pursued.

All regions and departments must strengthen coordination and cooperation, clarify responsibilities, division of labor, and progress requirements, and earnestly implement this opinion.
