Chapter 1 General Provisions

Article 1 In order to strengthen safety production supervision and management, prevent and reduce production safety accidents, safeguard people's life and property safety, and promote the coordinated economic and social development of the city, according to relevant laws and regulations such as the "Safe Production Law of the People's Republic of China" and other relevant laws and regulations. In the actual situation of this Municipality, these Regulations are formulated.

Article 2 These Regulations apply to the safe production of units engaged in production and business activities in the administrative area of ​​this Municipality and the supervision and management activities of relevant departments.

Where relevant laws and regulations provide otherwise for fire safety, road traffic safety, railway traffic safety, water traffic safety, and civil aviation safety, the provisions shall apply.

Article 3 The work of safety in production must adhere to the principles of safety first, prevention as the main, and comprehensive management. The government shall adopt unified leadership, supervise the departments according to law, be responsible for the overall situation of the company, and be involved in the supervision of social participation.

The people's governments at all levels, relevant supervision and management departments, and production and business units shall implement a responsibility system for work safety.

Article 4 People's governments at various levels shall strengthen their leadership over work safety and incorporate safety work into the national economic and social development plans and annual plans.

The people's governments at various levels shall ensure the funds required for supervision and management of production safety and include them in the budget of the government of the same level. The funds for controlling the hidden dangers of major production safety accidents involved in public safety, and emergency rescue and investigation of production safety accidents shall be guaranteed.

Article 5 The main person in charge of the production and business operation unit is the first person responsible for safety production, and is fully responsible for the safety production work of the unit; other responsible persons bear the direct management responsibilities for safety production work within their respective duties.

Production and business units should strengthen safety production management, establish and improve safety production responsibility systems, improve safety production conditions, and ensure safe production.

Article 6 The people in charge of the people's governments at all levels shall assume overall leadership responsibilities for safety production work in the region; other responsible persons shall assume direct responsibility for safety production work in accordance with the division of responsibilities.

The chief persons in charge of the relevant departments of the people's governments at all levels shall assume overall leadership responsibilities for safety production work within the scope of their own administration; other responsible persons shall assume direct management responsibilities for safety production work in accordance with the division of responsibilities.

Article 7 The municipal, district and county safety production supervision and administration departments perform the following comprehensive supervision and management responsibilities for safety production work:

(1) To formulate safety production plans and policies, analyze and predict the safety production situation within its own administrative region, and issue safety production information;

(2) To guide, coordinate, supervise and inspect the safety production work of the relevant departments of the people's governments at the same level and the people's governments at lower levels;

(3) To supervise and inspect the implementation of the safety production responsibility system by the relevant departments of the people's government at the same level and the people's governments at lower levels;

(4) Organizing joint inspections and special inspections of safe production within its own administrative region, supervising and inspecting major potential safety hazards;

(5) To organize, direct and coordinate the emergency rescue work for production safety, organize the investigation and handling of production safety accidents according to law, and supervise the investigation of accidents and the investigation of responsibility;

(6) To be responsible for the comprehensive statistical analysis of safety production accidents;

(7) To undertake the daily work of the production safety committee;

(8) Other duties stipulated by laws and regulations on production safety.

Article 8 The departments responsible for safety production supervision and management, such as safety production supervision, public security, construction and transportation, and quality and technical supervision, shall, in accordance with the provisions of relevant laws and regulations, implement special supervision and management of relevant safety production work within their respective scope of duties.

The government departments and agencies of industry, commerce, and state-owned assets supervision and management shall be responsible for the relevant work safety management in accordance with this Municipality's work safety responsibility system.

Article 9 The township and town people's governments and sub-district offices shall determine the safety production supervision and management institutions and personnel, and shall be responsible for the work safety supervision and management within their respective jurisdictions.

Article 10 The trade union shall organize the employees to participate in the democratic management and democratic supervision of the work safety of the unit according to law, participate in the investigation of production safety accidents, put forward opinions and suggestions for ensuring safe production, and safeguard the legitimate rights and interests of the employees.

Article 11 The people's governments at all levels and their relevant departments and production and business units shall take various forms to strengthen the publicity and education of safety production laws, regulations, and safety production knowledge so as to improve the accident prevention capabilities of production and business units and their employees.

Units such as news, publishing, broadcasting, television, newspapers, and periodicals shall carry out education and propaganda on safety production to enhance the awareness of safety in production in the entire society.

Article 12 The people's governments at all levels and their relevant departments shall give commendations and rewards to units and individuals that have made outstanding achievements in improving safe production conditions, preventing production safety accidents, and participating in rescue and rescue operations.

Chapter II Safe Production Protection of Production and Business Units

Article 13 A production and business operation entity shall have the conditions for safe production as prescribed by laws, regulations, and national or industrial standards; if it does not meet the conditions for safe production, it may not engage in production and business activities.

Article 14 Production and business entities shall abide by the following safety production regulations:

(1) Formulate safety production rules and regulations and operating procedures, and establish and improve the safety production responsibility system;

(2) production and operation sites and equipment and facilities meet the requirements for safe production;

(3) Set up safety production management agencies or staff with safety production management;

(4) The main responsible person, the person in charge of safety production work, and the safety production management personnel have the safety production knowledge and management capabilities that are compatible with the production and business activities undertaken by the unit;

(5) The employees are qualified for the safety production education and training of the unit, and the special operation personnel obtain the special operation operation qualification certificate according to the relevant regulations of the country;

(6) Occupational hazard prevention and control measures, and labor protection articles that meet the national standards or industry standards for employees. 

Mines, building construction units, and production and business entities for hazardous chemicals, fireworks, and civil explosives shall obtain safety permits.

Article 15 The principal person in charge of the production and business operation shall perform the duties of safe production as prescribed by the law. At least once a year, it shall report to the workers' congresses, employees' meetings, shareholders' meetings on the safety of production and accept supervision.

Article 16: Units engaging in production and business activities such as mining, road transportation, building construction, dangerous chemicals, fireworks, etc., shall set up safety production management agencies and staff with safety production management in accordance with the following provisions:

(1) If the number of employees is more than 1,000, a safety production management agency shall be set up, and full-time safety production management personnel shall be provided at a ratio of no less than five-thousandths of the employed personnel, among which at least three registered safety engineers or safety engineers shall be required;

(2) If the number of employees is less than one thousand but less than one thousand, a safety production management agency shall be set up, with two or more full-time safety production management personnel, of which at least one registered safety engineer or safety engineer shall be required;

(3) If the number of employees is less than 100, full-time safety production management personnel shall be provided.

Article 17 Other production and business entities other than those stipulated in Article 16 of these Regulations shall, in accordance with the following provisions, establish a production safety management organization and staff with safety production management:

(1) If the number of employees is more than 300, a safety production management agency shall be set up, equipped with more than two full-time safety production management personnel, at least one of which shall be a registered safety engineer or safety engineer;

(2) if there are fewer than 100 employees and less than 300 employees, full-time production safety management personnel shall be provided;

(3) Where the number of employees is less than 100, full-time or part-time safety production management personnel shall be provided.

Article 18 Production and business operation entities may entrust safe production service agencies or employ registered safety engineers to provide them with safe production services.

Article 19 Production and business operation units shall ensure the necessary capital input for safe production conditions and include the safety production funds in the annual financial plan.

Article 20 This Municipality encourages production and business units such as mines, road traffic and transport, construction, dangerous chemicals, and fireworks to insure production safety liability insurance.

Where the production and business operation entity specified in the preceding paragraph does not cover the production safety liability insurance, it shall, in accordance with State regulations, store risk deposits at one time with the risk collateral agent banks designated by the municipal work safety supervision and administration department and the municipal finance department for the production safety of the unit. Article 21 In the production and business activities, employees shall enjoy the following rights:

(1) Ensuring safe production, prevention of occupational hazards and employment injury insurance, etc.;

(b) to understand the dangers of occupational hazards, occupational hazards, and prevention and emergency measures;

(3) obtaining and using labor protection articles that conform to national standards or industry standards;

(d) Participate in relevant safety production knowledge and skills training;

(5) obtaining occupational health examinations in accordance with relevant regulations;

(6) making suggestions, criticisms and opinions on the work safety of the unit, and prosecuting and accusing the production of illegal activities;

(7) Command orders that refuse to operate in violation of rules;

(8) When there is a direct threat to personal safety, take possible emergency measures to stop operations or to evacuate the workplace;

(9) Obtaining compensation in accordance with law for damages caused by production safety accidents;

(10) Other rights provided by laws and regulations.

Article 22 In production and business activities, employees shall perform the following obligations:

(1) Observe the safety production rules and regulations and operating procedures of the unit, obey the management, and properly use labor protection articles;

(2) Accept safety production education and training, and master the safety production knowledge and skills required for their own work;

(3) discovering and reporting accident risks and unsafe factors in a timely manner;

(4) Other obligations stipulated by laws and regulations.

Article 23 The chief persons in charge of production and business units such as mines, road transportation, building construction, hazardous chemicals, fireworks and firecrackers, the person in charge of production safety work, and the safety production management personnel must regularly receive specialized safety production education. Training can only be performed after the relevant competent authority has passed the assessment. No fee for assessment.

The main person in charge of other production and business operation units other than the preceding paragraph, the person in charge of safety production work, and the safety production management personnel shall receive the training organized by the production safety supervision and management department.

Article 24 The production and business operation entity shall, in accordance with the following provisions, conduct training on the safe production of its employees and establish and improve the training files:

(1) Conduct pre-post training for newly recruited employees;

(2) Specialized training for traders who have switched jobs or employ new processes, new technologies, new materials, and new equipment;

(3) Training for workers returning to work after more than half a year of resumption of work;

(d) Conduct at least one full-time safety production education each year.

Employees who are not qualified for training shall not be employed.

Article 25 Production and business entities that have occupational hazards shall, in accordance with State regulations, take protective measures against the production sites of production poisons, dust, noise, vibration, high temperature, radiation, and other occupational hazards, and shall be provided by an organization with appropriate qualifications annually. At least one occupational hazard test shall be conducted, and at least one occupational hazard assessment shall be conducted every three years. After testing and evaluation do not meet the occupational health standards, it must take timely measures to control.

Article 26 Production and business units that have occupational hazards shall be provided with special personnel to take daily monitoring of occupational hazards at the workplaces to ensure that the monitoring system is in normal working condition. The results of monitoring should be announced to practitioners.

Occupational hazards of production and business operation units shall be subject to the annual declaration of the occupational hazards of the unit to the safety production supervision and management department in accordance with relevant state regulations, and shall be subject to supervision and inspection by the safety production supervision and administration department.

Article 27 The safety facilities of new, reconstructed or expanded construction projects (hereinafter collectively referred to as construction projects) of production and business units must be designed, constructed and put into production and use at the same time as the main project.

The production and business operation entity shall organize inspection and acceptance of the safety facilities of the construction project in accordance with the relevant regulations. After passing the inspection and acceptance, the production and business operation unit may put into operation and use, and report the acceptance report to the safety production supervision and administration department for the record.

For major construction projects or construction projects with major risk factors, the production and business operation entity shall carry out safety pre-evaluation in the design phase according to relevant safety regulations, conduct acceptance safety evaluation during the acceptance stage, and timely report the safety assessment report to the safety production supervision and management department. .

Article 28 Production and business units shall take the following measures for major sources of danger:

(1) Establishing a sound risk source management system;

(2) to conduct dynamic monitoring of the entire operation situation and eliminate existing hidden dangers in time;

(3) To conduct regular inspections and assessments;

(4) To formulate special emergency rescue plans and organize at least one drill each year. The production and business operation entity shall report to the local production safety supervision and management department and related departments on the implementation of the major hazard source monitoring and corresponding safety measures of the unit each year.

Article 29 Units that engage in production and business activities such as mining, road transportation, construction, hazardous chemicals, fireworks, metal smelting, and large-scale commerce shall, in accordance with the relevant regulations, conduct regular safety assessments of their own safe production conditions, and shall ensure safety. The evaluation report is filed with the department responsible for safety production supervision and management.

Article 30 The operating sites of production and business entities shall meet the following safety production regulations:

(1) Maintaining cleanliness, stable distribution of raw materials, semi-finished products and finished products, timely removal of wastes and wastes;

(2) The roads in the factory (field) area are flat and unobstructed, and obvious traffic and warning signs are set at turning points, intersections and dangerous working areas. The erection and identification of pipes, lines and trestles are in line with national standards;

(3) The pits, mouths, bowls and pools needed for production must be covered or fenced, and pits and trenches for construction excavation should be provided with guard rails and warning signs;

(4) Under the overhead transmission lines, hoisting machinery operations or building structures or structures are prohibited;

(5) It is forbidden to use house beams as lifting support;

(6) Operating in places where air circulation is not easy, poisonous and harmful gases are likely to occur, and personnel may be suffocated or poisoned, safety measures shall be taken and corresponding safety protective equipment shall be provided;

(7) For the manual dredging of large-scale equipment where clogging occurs, safety measures such as anti-dropping and anti-burial shall be taken, and guardians shall be set up.

Article 31 The mechanical electrical equipment of a production and business operation entity shall meet the following safety production regulations:

(1) The insulation of electrical equipment, power tools and electrical lines must be good and equipped with leakage protection devices. The metal casing and power tools of electrical equipment should be protected by zero or ground. The zero line of protection and zero-crossing should be used to protect the neutral line. Lay out separately;

(2) Closed-type electrical equipment should be used in the workplaces where moisture and dust, steam, and corrosive gases are generated;

(3) The temporary electrical lines required for the production and operation sites shall be laid by the electricians in accordance with relevant regulations, and shall be dismantled promptly after use;

(4) All parts of the machinery, such as exposed transmission, rotation and pressure, shall have safety protection devices and maintain good conditions;

(5) The maintenance, troubleshooting, and cleaning of machinery and equipment shall be stopped and the power shall be cut off in accordance with the operating procedures, and warning signs shall be hoisted.

Article 32 Inflammable and explosive workplaces shall meet the following safety production regulations:

(1) The equipment and facilities must comply with relevant regulations and remain intact;

(2) It is forbidden to wear and use clothing, shoes, hats, and tools that are prone to static electricity and sparks;

(3) the use of explosion-proof electrical equipment and facilities;

(4) Equipment and facilities shall be equipped with safety monitoring systems such as over-limit alarm, explosion-proof pressure relief, insurance control, and anti-static protection, and ensure their normal operation;

(5) The hot work approval system shall be strictly implemented during hot work.

Article 33 Metal smelting operation sites shall meet the following safety production regulations:

(1) Set up monitoring and early-warning systems at places where gas transmission and storage are prone to gas leakage and accumulation, and establish and improve the maintenance system for gas facilities and equipment;

(2) The smelting equipment shall meet the relevant safety standards of the State and the industry, and shall not be used if it does not meet the standards;

(3) No personnel gathering place shall be set up within the scope of influence of the lifting of high-temperature liquid metal.

Article 34 It is prohibited to use prefabricated mobile homes that do not meet the national fire safety standards as a centralized accommodation place. If a prefabricated mobile home that complies with the national fire safety standards is used as a centralized accommodation place, safety voltage should be used, and heating in the form of fire can not be used in winter.

Article 35 In the process of production of dangerous chemicals, fire, explosion, and poisoning processes, as well as posts of toxic gases such as phosgene, chlorine, hydrogen sulfide, ammonia, etc., shall be determined by special personnel; production of hazardous chemicals The storage, use, and use units should be equipped with appropriate chemical professionals and electricians.

Article 36 Production and business entities that develop new dangerous chemicals shall organize experts with appropriate qualifications to appraise the process safety of intermediate and industrial production.

Article 37 The safety protection distances surrounding the newly built gas stations and gas filling stations shall comply with relevant state regulations. If the original gas station or gas filling station cannot meet the requirements for safety distance protection, safety technical measures such as barrier explosion protection and oil and gas recovery should be adopted to meet the safety protection requirements.

Article 38 The production and business operation units shall carry out dangerous operations such as blasting, lifting, demolishing of buildings, excavation of earthwork, etc., and shall formulate safety protection plans and on-site emergency disposal plans, and arrange special personnel to take charge of on-site safety management.

For construction projects such as deep foundation pits, underground excavation works, tall formworks, and gas jacking, etc., a construction safety plan shall be formulated, and the reliability of the safety measures of the construction plan shall be expertly demonstrated. Safety management personnel shall implement on-site safety supervision.

Article 39 Where a production and business entity rents workshops, premises, facilities and equipment to other units to engage in production and business activities, both parties to the lease shall sign a safety production management agreement and agree on the responsibility for safe production management.

Article 40 Units that engage in high-hanging operations such as cleaning of outer walls, maintenance of advertising facilities, and installation of air-conditioning equipment shall be equipped with safety production management personnel to take charge of the work safety management of the unit and the safety inspection and monitoring of the work site. Operators shall, after special training for special operations and in accordance with the state-specified special operations, obtain relevant qualification certificates for special operation operations before they can perform jobs.

Hanging equipment such as spreaders and hanging baskets used in the operation shall have relevant information such as product certifications and operating instructions. The spreaders and baskets must be equipped with safety ropes and safety locks that meet safety standards. They can be used only after passing inspection and inspection.

Article 41 It is forbidden for catering service operators and unit canteens to use more than fifty kilograms of pressurized canned fuel as a cooking heat source; when using two or more pressurized canned fuels of less than fifty kilograms, they shall be used in a decentralized manner and safety precautions shall be taken. .

Chapter III Supervision and Administration

Article 42 The municipal, district, and county people's governments shall hold at least one safety production work conference every quarter. The meeting mainly includes the following contents:

(I) Analyze the safety production situation;

(B) Coordinate the resolution of major issues in safety production;

(3) Supervising and inspecting the management of hidden dangers and accident prevention of major accidents in the administrative area;

(4) Notifying the control of safety production accident indicators;

(5) arranging phased key work.

Matters decided by the meeting, the relevant departments should report to the people's government at the same level within 10 days of implementation.

Article 43 The people's governments at all levels and their relevant departments shall supervise the implementation of the responsibility system for production safety in accordance with the following provisions:

(1) The higher people's government is responsible for supervising the lower level people's government;

(2) The people's governments at various levels are responsible for supervising the relevant departments of the people's governments at the same level;

(3) The relevant department is responsible for supervising the production and business units within its scope of responsibilities;

(d) The township and township people's governments and sub-district offices shall be responsible for supervising the production and business units that do not have competent authorities in their jurisdictions.

Article 44: The people's government and its relevant departments shall perform the following duties of supervision over production safety responsibility:

(1) To guide the establishment and improvement of the responsibility system for production safety;

(2) to supervise and urge the relevant units to investigate and deal with potential safety hazards;

(C) Coordinate the resolution of major and common problems in safe production;

(4) To master the implementation of the responsibility for safe production of the relevant units;

(5) Conduct annual comprehensive assessment of the supervised units;

(6) Other matters requiring supervision.

Article 45 Prior to March 31 of each year, the people's governments at all levels and their relevant departments and the supervised units signed a responsibility letter for safe production.

Article 46 The municipal safety production supervision and management department shall, in conjunction with relevant departments, organize the assessment of the city's production safety responsibility system.

Article 47 Where the production safety supervision and management department and other departments responsible for supervision and management of production safety find any major accident hazards during the inspection, they shall implement a special supervision system, specify the responsible units, issue rectification instructions, and rectify within a time limit.

Article 48 Villagers' committees and residents' committees shall report to local people's governments or relevant departments in a timely manner if they discover hidden accidents, illegal production safety, and production safety accidents. Local people's governments and their related departments shall promptly handle the reports after they have received reports from the villagers' committees and residents' committees.

The villagers' committees and residents' committees can set up security personnel to conduct daily security inspections.

Article 49 The management institution of an industrial park shall determine the safety production management agency or personnel, be responsible for the supervision and administration of safe production within the park, and accept the business guidance of the production safety supervision and administration department.

Article 50 The municipal, district, and county safety production supervision and administration departments shall regularly announce the status of safe production to the public, and promptly disclose the investigation and handling information of serious and unsafe production safety violations and production safety accidents. The municipal safety production supervision and management department shall promptly notify the large and major production safety accidents and typical accidents with large social impact.

Article 51 This Municipality shall implement the standardization of safety and safety management of production and business units. The municipal, district and county safety production supervision and administration departments shall guide and supervise the implementation of safety standardization.

Article 52 The municipal work safety supervision and administration department shall establish a recording system for records of violations of production safety, and record the illegal production and handling results of production and business units, as well as other relevant safety production information.

Units and individuals can query the safety production record system related information.

Article 53 An agency engaged in the evaluation of safety production services shall carry out its work in accordance with the relevant provisions of the State, and shall not have the following acts:

(1) transferring and subcontracting the service items undertaken to other units or individuals;

(2) Conducting safety evaluations on the construction projects designed by this institution;

(3) issuing false or inaccurate safety assessment reports;

(d) Violation of evaluation procedures;

(5) Other acts that violate the law for safety evaluation.

Article 54 Any unit or individual that discovers that a production and business operation unit has a hidden danger of safety accidents or an illegal act of safe production shall have the right to report to the production safety supervision and management department and relevant departments.

Safety production supervision and management departments or relevant departments shall promptly conduct investigations and handlings, keep secrets for the whistle-blowers, and give rewards to those who report the merits.

Article 55 Within the limits of the area within the outer ring line and the urban area of ​​the district or county, the construction of new hazardous chemicals production and storage projects shall be prohibited; the original hazardous chemical production and storage projects shall be gradually relocated according to the plan.

Newly constructed dangerous chemical construction projects in this Municipality shall enter the industrial park in accordance with the urban planning and relevant requirements.

Chapter IV Emergency Rescue and Accident Investigation and Treatment

Article 56 The municipal, district, and county people's governments shall establish an emergency rescue system for production safety, supervise and instruct the relevant government departments at the corresponding level and the lower level people's governments to do a good job in emergency rescue work for production safety.

The municipal and district/county people's governments shall establish and timely update safety production emergency plans, major hazard source information databases, reserve and timely update emergency rescue materials and equipment, establish emergency rescue teams, train emergency rescue workers, and organize emergency production rescue exercises.

Article 57 Production and business operation entities shall establish emergency rescue organizations, formulate emergency rescue plans, and provide corresponding emergency rescue equipment and equipment.

Mines, road transportation, building construction, hazardous chemicals, fireworks, metal smelting, large-scale commercial and trade production and business units shall establish emergency rescue teams and organize at least two emergency rescue drills each year. Smaller production and business units A mutual assistance agreement can be signed with a nearby full-time rescue team.

The production and business operation entity shall submit the safe production emergency rescue plan to the safety production supervision and management department and the relevant competent department for record.

Article 58 After a production safety accident occurs, the accident-producing entity shall report to the safety production supervision and management department and the competent authority at the higher level within one hour; among them, fire, acute poisoning, leakage of hazardous substances, special equipment and motor vehicle traffic accidents. It shall report to the competent departments of public security fire control, public health, environmental protection, quality supervision, public security traffic control, etc. at the same time.

After the safety production supervision and management department and related departments receive the accident report, their responsible person shall immediately go to the scene of the accident and organize the accident rescue.

Article 59 The accident investigation shall be divided into the following categories:

(1) The major accidents are organized by the Municipal People's Government to organize an accident investigation team to conduct an investigation.

(II) The larger accidents are organized by the municipal safety production supervision and management department to organize relevant departments to conduct investigations.

(3) In the case of a general accident, the relevant district or county safety production supervision and management department shall organize relevant departments to conduct the investigation; where no serious injury or death or direct economic loss of one million yuan is caused, the accident-producing agency shall be responsible for the investigation, and The results of investigation and treatment report the place where the accident occurred. Safety production supervision and management department. Where laws and regulations provide otherwise, they shall be stipulated.

Article 60 The unit responsible for accident investigation shall organize an accident investigation team to investigate the accident in accordance with relevant state regulations and form an accident investigation report. After the accident investigation report has been signed by the members of the accident investigation team, the unit responsible for the accident investigation shall submit it to the people's government at the same level or its authorized department.

If members of the accident investigation team have different opinions on the cause of the accident, the determination of the liability, the proposal for handling the responsible party, etc., they shall be recorded on the case. The accident investigation report should explain different opinions.

The municipal and district/county people's governments or their authorized departments shall, within the stipulated time limit, approve the accident investigation report.

Within 30 days of receiving the approval, the accident-producing entity shall report the implementation of the approval to the people's government or safety production supervision and management department that organized the accident investigation.

Article 62 If an accident-causing entity misreports, conceals or destroys an accident site and causes the accident to pass through, causes and responsibilities cannot be ascertained, it may be deemed as a production safety responsibility accident of the entity.

Article 63 Production and business operations units that have suffered serious injuries and deaths and production safety accidents shall timely conduct safety assessments and take corresponding safety precautions in accordance with the evaluation results.

Article 64 The relevant competent department shall, before the 5th of the month, submit the statistical statements of accidents such as road traffic, fire, building construction, special equipment, railway traffic and agricultural machinery to the safety production supervision and management at the same level last month. department.

Chapter V Legal Liability

Article 65 Where a production and business operation entity commits any of the following acts, the production safety supervision and management department shall order it to make corrections within a time limit; if it fails to correct it within the prescribed time limit, it may impose a fine of more than 2,000 yuan but less than 10,000 yuan:

(1) failing to set up a production safety management agency or staff with safety production management in accordance with Article 16 and Article 17 of these regulations;

(2) failing to provide training for employees in accordance with the provisions of Article 24 of these Regulations for safe production.

Article 66 If a production and business entity violates the provisions of Article 20 of these regulations and does not invest in production safety liability insurance or store safe production risk deposits, the safety production supervision and administration department or other relevant departments shall order them to make correction within a time limit; , may temporarily detain or revoke the safety production license.

Article 67 Where a production and business entity violates the provisions of Article 25 of these Regulations and fails to conduct regular inspections of occupational hazard factors and the evaluation of occupational hazard status, the safety production supervision and administration department shall order it to make corrections within a time limit; if it is not corrected after the due date, it may go to A fine of more than 1,000 yuan and less than 20,000 yuan.

Article 68 If a production and business entity violates Article 27 of these Regulations and one of the following acts is committed, the production safety supervision and management department shall order it to make corrections within a time limit; if the production and business entity fails to correct it within the prescribed time limit, it shall be ordered to stop construction or to stop production for rectification and rectification. Fines of more than 10,000 yuan but less than 50,000 yuan:

(1) The safety facilities of a construction project fail to pass the inspection and are put into production without permission;

(2) Major construction projects or construction projects with major risk factors have not been evaluated for safety in accordance with relevant regulations.

Article 69 Production and business units violate the provisions of Article 40 of these Regulations and use high-level personnel who have not obtained qualification certificates for special operations, or they are not equipped with spreaders, baskets, safety ropes and safety locks that meet safety standards. For operations, the safety production supervision and management department shall order it to stop operations, make corrections within a time limit, and impose a fine of more than 10,000 yuan but less than 30,000 yuan.

Article 70 Where a production and business entity violates the provisions of Article 41 of these regulations by using pressurized canned fuel, the fuel gas administration department shall order it to make corrections within a time limit; if the production and business entity fails to make corrections within the prescribed time limit, the fine shall be between RMB 1,000 and RMB 10,000.

Article 71 If a professional service organization engaged in safety production evaluation violates the provisions of Article 53 of these Regulations to carry out safety evaluation activities, the safety production supervision and administration department shall order it to make corrections within a time limit; if it is overdue, it shall be 10,000 yuan or more and 30,000 yuan. A fine of less than RMB shall be imposed; where a false certificate is issued, it shall be dealt with in accordance with the relevant provisions of the Work Safety Act.

Article 72 Where a production and business entity violates the provisions of paragraph (3) of Article 59 of these Regulations by failing to submit an accident investigation report, the production safety supervision and administration department shall order it to make corrections within a time limit; if the production and business entity fails to correct it within the time limit, it shall be 20,000 yuan or more and 50,000 yuan. Article 73. If a state organ with the responsibility for supervision and administration of production safety and its managerial staff appointed by the state administrative organs among its staff and enterprises and institutions does not perform the duties of safe production management in accordance with the law, it shall be given a sanction in accordance with the relevant regulations of the State; If a crime is committed, criminal responsibility shall be investigated according to law.

Article 74 If any laws or administrative regulations have penalties for violation of safety production laws, administrative regulations and the provisions of these Regulations, provisions shall prevail.

Article 75 The term "production safety accident" as mentioned in these Regulations refers to a production safety incident that causes casualties or direct economic losses in the course of production and business operations and a production safety accident caused by improper rescue and rescue after an accident. .
